Historic ruling: GEMA prevails against OpenAI

OpenAI was found liable on November 11 in a court in Munich. "Congratulations to our colleagues at GEMA for a historic ruling that puts its foot down: copyright also applies in the AI era," says Lina Heyman, Chief Legal Counsel at STIM.
In a legal case that has attracted global attention and was brought by GEMA against the American AI service OpenAI, the regional court in Munich on November 11 issued a very clear ruling: the way OpenAI currently operates ChatGPT violates applicable European copyright laws. For the first time in Europe, the question of generative AI's use of copyrighted works has been tested legally – and the judgment went in favor of the rights holders.
