License for music in theater, stand-up productions and lectures

For public performance of Music in theater productions, stand-up and lectures the Licensee pays a fee per occasion to Stim according to the table below. The license covers background music in a theater production, both recorded and live, as well as music between acts, during intermissions and before the play begins and after it has ended (immediately thereafter).

It is important to pay attention to how the music is used because there is a limit to what Stim can license. If, for example, the music is a central element in a theatrical performance or choreographic work or if there is an action supported by the music, you may sometimes need to seek a license directly from the rights holder (publisher and/or creators). Find out whether your performance/production with music is covered by a Stim license or if you need to seek permission directly from the rights holders (authors and/or publisher).

The minimum fee is SEK 355 per invoicing occasion.

Reproduction

For copying, transferring or storing music on, for example, CD or other media for playback in the performance, the licensee pays a fee of SEK 100 per copy. Recordings where advertising and music are mixed require a special permit.

The licensee shall pay the fee according to the interval stated in the License Confirmation or Special Agreement. The License Confirmation or Special Agreement also states whether the Licensee shall pay the fee in advance or afterwards. If the Licensee is to pay afterwards, there are special rules on Reporting in the General Terms.

Reporting of performed music

The Licensee shall report music in accordance with what is stated in General Terms.

Note regarding the scope of the License

It is specifically noted that the License does not cover public performance of choreographic works (e.g. ballet) or original music for a play. The License also does not include the right to perform unauthorized lyrics.

Other

Advance notification

If Stim so requests, the Licensee is obliged to notify Stim of planned events in advance. The notification must be submitted at least seven calendar days before the planned event and must include details of the date, venue and location.

Visits

STIM has the right to visit events in order to verify that the Licensee provides correct information about accounting and music reporting. STIM shall give advance notice of visits and the Licensee shall then provide two admission tickets free of charge.

Provision of premises and responsible organizer

If a Licensee makes premises available to a third party (a so‑called responsible organizer), the responsible organizer shall normally obtain a license. The Licensee shall notify STIM that a responsible organizer has used the premises and state the date of the provision. The Licensee shall also inform the responsible organizer that they may need to obtain a license from STIM. If the responsible organizer does not obtain a license when required, the Licensee may be regarded as responsible for the use of music.

By 'responsible organizer' is primarily meant the person who holds a permit under the Public Order Act or a permit to sell food or alcohol on the premises. Otherwise, it refers to the person in whose cashbook ticket revenues are recorded. Independent ticket agents are not regarded as responsible organizers if the majority of the proceeds from ticket sales accrue to someone else. At events with free admission, the person who has the primary financial reporting responsibility for most of the costs is considered the responsible organizer.
