License for music in exhibitions and art installations

For public performance of Music in connection with exhibitions and art installations, the Licensee pays a fee to STIM as follows.

Copying

For copying, transferring or storing music on e.g. CD or other media used in exhibitions and art installations, the licensee pays a fee of SEK 100 per copy. Recordings where advertising and music are mixed require a special permit.

The Licensee shall pay the fee according to the bracket shown in the License Confirmation or Special Agreement. The License Confirmation or Special Agreement also indicates whether the Licensee shall pay the fee in advance or in arrears. If the Licensee is to pay in arrears there are special rules concerning Reporting in the General Terms.

Special terms

Music reporting of performed Music

The Licensee shall submit music reporting in accordance with what is set out in the General Terms. The obligation to submit music reporting applies only where the Music has been specifically selected for the exhibition or installation and forms a prominent part of the exhibition, as opposed to music used as background.

Note regarding the scope of the License

It is specifically noted that the License does not cover live music.

Other

Advance notification

If STIM so requests, the Licensee is obliged to notify STIM of planned events in advance. The notification must be submitted at least seven calendar days before the planned event and must include information on the date, venue and location.

Visits

STIM has the right to visit events in order to verify that the Licensee provides correct information about Reporting and music reporting. STIM shall announce visits in advance and the Licensee shall then provide two entrance tickets free of charge.

Provision of premises and responsible organizer

If a Licensee lets premises to a third party (a so-called responsible organizer), the responsible organizer shall normally take out a license. The Licensee must inform STIM that the responsible organizer has used the premises and state the date of the letting. The Licensee must also inform the responsible organizer that they may need to take out a license with STIM. If the responsible organizer does not take out a license when required, the Licensee may be considered responsible for the use of music.

A responsible organizer primarily means the person who holds a permit under the Public Order Act or a permit for the sale of food or alcohol on the premises. Secondly, it means the person in whose cashbook ticket revenues are recorded. Independent ticket agents are not considered responsible organizers if the majority of the proceeds from ticket sales benefit someone else. At free-entry events, the person who has the financial accounting responsibility for the majority of the costs is considered the responsible organizer.
